Leaf Living Application Terms and Conditions
Key Dates
- I/We agree that the Deadline for Agreement will be 3 working days before the expected move-in date.
- I/We understand that the Deadline for Agreement is the last date by which we must enter into a Tenancy Agreement. The signed contract must be returned by this date.
- Once the holding deposit is paid, the agreed move-in date cannot be changed unless under exceptional circumstances.
Terms and Conditions of Offer
- I/We understand that the Primary Applicant’s agreement applies on behalf of the entire household.
- The property will only be held once the holding deposit has been paid.
- I/We agree to pay a holding deposit of the equivalent to 1 weeks’ rent via the Application Portal. By making this payment, I confirm that I am the cardholder and authorised to make the payment. If it's found that I do not have authorisation, I authorise Leaf Living to release the details of the application form to third parties.
- I/We understand that the move-in date is subject to property readiness, completed referencing, executed Tenancy Agreement/other documents, and final payment. While both parties will make efforts to meet this date, it may change due to delays.
- I/We acknowledge that a minimum household income (30 x the rent per annum) is required to ensure affordability. Proof of income will be provided by the Date for Completed Documentation as per the Reservation Checklist.
- I/We understand that in addition to providing documents to Leaf Living, I/we will need to submit additional proofs and references to a third-party referencing company.
- I/We agree to receive the signed Tenancy Agreement, Welcome Pack, and notifications by email to the addresses provided.
- If I/we withdraw from the lettings process, the Deadline for Agreement will be adjusted to the day after the withdrawal notice. Leaf Living may retain the holding deposit and issue a notice within seven days.
- I/We understand that Leaf Living may receive a referral fee for services such as Flatfair, Sky TV, insurance, furniture, etc.
- The Leaf Living Privacy Policy and how personal data is used can be reviewed at www.leafliving.com/privacypolicy.
- I/we understand that Leaf Living will process my/our personal data in accordance with the UK General Data Protection Reulation and UK Data Protection Acts 2018. Where appropriate and necessary, Leaf Living may share my/our personal data with third parties, including but not limited to:
- Referencing agencies
- Government backed tenancy deposit protection schemes
- Third party service providers who assist with utilities, internet, and other tenancy related services.
This data sharing is strictly for the purpose of enabling those providers to deliver services related to my/our tenancy. Leaf Living ensures that any third parties with whom data is shared are carefully selected and required to comply with data protection laws. I/we understand that these third parties may contact me/us directly to arrange service setup or provide information necessary for service delivery. Leaf Living does not share my/our data with third parties for marketing purposes without my/our explicit consent.
- I/we understand that following the commencement of our tenancy and subject to us complying with the terms of the Tenancy Agreement and only if applicable, Leaf Living will apply (at its discretion) a credit of either 2 week or 1 calendar months’ rent and such credit will be applied on a the third month of the tenancy.
- I/We understand that we may be reserving a property prior to its completion that I/we have not seen in person and are basing this decision on floor plans, site plans and CGI images. These are indicative only and may not accurately reflect the final property, including layout and specification. A viewing is therefore recommended to confirm suitability. The holding deposit will be non-refundable if, upon viewing, you no longer wish to proceed.
Circumstances for Holding Deposit Retention
I/We understand that Leaf Living may retain the holding deposit under the following circumstances:
- Failure to provide proof of immigration status.
- Providing false or misleading information during the application.
- Withdrawal from the lettings process.
- Failure to take reasonable steps to sign the Tenancy Agreement by the Deadline for Agreement.
Reservation Checklist
- Terms of Tenancy
- From 1 May 2026, all residential tenancies—both new and existing—will automatically become periodic. This means all tenancies will operate on a month by month basis rather than for a fixed term. In line with the new rules, two months’ notice can be served.
- Rent can only be increased once a year at market rates. Leaf Living as landlord will provide at least two months' written notice using a formal Section 13 notice, and you have the right to challenge the increase at a tribunal if you believe it exceeds market value.
- Costs
- All payments must be made from the same account holder. The holding deposit is equivalent to 1 weeks’ rent. Upon signing the Tenancy Agreement, additional payments will be required Flatfair deposit fee or 5 weeks’ rent as a tenancy deposit and first month’s rent or prorated depending on the move-in date.
- Required Documentation
- Documentation must be submitted at least 3 days before the tenancy is due to commence. These may include:
- Proof of identity and immigration status (passport, visa, etc.).
- Proof of employment (last 3 months’ payslips and bank statements if employed or SA302 and 6 months of bank statements if self-employed).
- Proof of address (recent utility or council tax bill).
- Proof of funds (most recent savings or current account statement).
- Failure to provide requested documentation by the deadline may result in the holding deposit being retained.
- Documentation must be submitted at least 3 days before the tenancy is due to commence. These may include:
- References
- A credit check will be conducted by a third-party agency, and references will be requested from employers/accountants and landlords for the past 12 months.
- A sanctions check will be carried out on all adult members of the household against the UK Government sanctions list, and if any confirmed matches are found, Leaf Living will be unable to progress with the application.
- A failed reference due to undeclared adverse credit history or financial mismanagement will result in a failed application.
Development Checklist
- Ongoing Construction
- The development may still be under construction. Expect construction noise, traffic, and dirt. Leaf Living has limited control over these factors.
- Completion Timescales
- As this is a new development, completion dates are estimates. Delays may occur, and Leaf Living will not be responsible for any costs incurred due to delays.
- Utilities
- Electricity and gas suppliers: OVO (can be changed).
- Satellite Dishes
- Installing additional services like Sky requires written approval from the Property Manager.
- Broadband
- Complimentary Wi-Fi will be provided. This may not be available from your move in date. We cannot accept cancellation or removal of the WiFi, this will be charged back to you if this occurs.
- Specification
- Properties are unfurnished, with kitchen appliances and blinds installed in bedroom windows and on the front elevation of the property. Wall decor in show homes is not included.
- Parking
- At least one parking space is provided. Parking must be done responsibly. Leaf Living is not responsible for improperly parked vehicles or fines
- Pets
- Pets are permitted with prior authorisation, at no extra cost.
